INTRODUCTION

ELTEL Services, is a company registered in the Cameroon trade register under number RC/YAO/2013/A/4907, and whom headquartered is in Yaoundé. ELTEL Services provides users of IT and telecommunications products and services with the opportunity to purchase supplies on the website www.eltel.shop/en. Access to and use of the website are subject to these terms of use (“TU”) which the user declares to have read and accepted by using the website. The website www.eltel.shop/en  is open to any individual with internet access who wishes to use it to purchase products and services for personal use. Use of the website www.eltel.shop is therefore subject to the following terms of use, which will govern commercial transactions on this platform.

ARTICLE 1 : DÉFINITIONS

In these terms of use, the following terms have, unless otherwise indication, the meanings given to them in this article:

  • TU: refers to terms of use of the eltel.shop website.
  • The website: refers to the website www.eltel.shop which allows you to purchase our products and services.
  • CFAF: refers to the currency that is accepted for payments on the site.
  • User: refers to a natural person of legal age using the website “www.eltel.shop” in a non-commercial and strictly personal context.
  • ELTEL: refers to the company ELTEL Services
  • NAICT: refers to the national agency for information and communication technologies.

ARTICLE 2: PURPOSE

The purpose of these Terms of use is to define the conditions under which the site is used by users.

ARTICLE 3: TECHNICAL REQUIREMENTS AND DATA CONSUMPTION

The use of www.eltel.shop is permitted to any adult with internet access via a smartphone or computer who wishes to use the website for their own personal, non-commercial purposes. Use of the website may involve the transmission of data to and from the user's device, which may incur charges from the user's internet service provider. Therefore, it is strongly recommended that users ensure their mobile plan is compatible with the site. ELTEL cannot be held liable for excessive data consumption.

ARTICLE 4: DESCRIPTION AND USE OF THE WEBSITE

  • Description: the website www.eltel.shop allows users to purchase IT and telecommunications products and services. Users simply select products or services on the platform, indicate their payment method and delivery location.
  • The Offers: this refers to all the products published on the website and therefore presented to all visitors, who are potential buyers. Each product is presented with a name, one or more images, a short description, its price, a longer description, and an "add to cart" button. These offers are available to individuals who will purchase them for their own personal use and are strictly prohibited from reselling. Product prices are subject to change without notice.
  • Shopping: this step involves putting in his cart all products that interest him can be added to his cart by clicking the "add to cart" button accompanying each product. ELTEL Services reserves the right to cancel a cart if its contents are deemed suspicious for personal use.
  • The placing the Order: this stage, the buyer, having previously checked the contents of their basket, has filled out the order form in which they provide a delivery address, the delivery method, and choose a payment method from the available options.
  • Payment: in principle, payments are made upon delivery. However, delivery of certain orders is subject to a prepayment requirement. Indeed, depending on the total invoice amount and the delivery location, you will be required to pay either a prepayment or the full invoice amount via our merchant accounts (ELTEL SERVICES), MTN Mobile Money, and Orange Money in order for delivery to be completed.
    Therefore, we ask that you make the payment of the aforementioned amount or the advance payment within the timeframe communicated to you by our Customer Service department upon confirmation or placement of your order. Otherwise, your order will not be processed. Please note that in these cases, payments are made exclusively through our merchant accounts.
  • Delivery: it is carried out by an internal ELTEL delivery agent or by an agent of one of our delivery partners under the conditions below:
    • The place: delivery takes place between 9am and 4pm at a location agreed upon by mutual agreement between ELTEL SERVICES and the buyer.
    • The deadlines: delivery times begin from the date of order confirmation. This timeframe depends on the availability of the item in question. In the event of force majeure preventing delivery within this timeframe, it will be extended with the customer's agreement.
    • The cost: delivery charges depend on the distance. They range from 500 to 2000 CFA francs in the Mfoundi and Wouri departments. For the rest of the country, delivery consists of shipping the product from Yaoundé or Douala via a parcel delivery agency, at the buyer's expense.
    • Verification and complaints: upon receiving your order, the buyer is required to immediately verify, in the presence of the delivery agent, the conformity and condition of the packaging and the condition of the product. In case of non-conformity, claims must be made to ELTEL SERVICES customer service at the email address eltelservice@outlook.com, by telephone at 659796606 or 242181425, and via WhatsApp at 242181425.

ARTICLE 5: PROVISIONS CONCERNING EVIDENCE

It is expressly agreed that ELTEL and the User may communicate electronically for the purposes of their transaction, provided that technical security measures are taken to ensure the confidentiality of the data exchanged.
ELTEL and the User agree that the electronic exchange between them validly represents the content of their discussions and, where applicable, their commitments.

ARTICLE 6: PERSONAL DATA

The personal data collected during the use of the application is processed by ELTEL, which is then responsible for it. Within the framework of this service, ELTEL carries out the following processing activities:

  • To identify users, ELTEL may collect users' telephone numbers and email addresses, payer numbers, and beneficiary numbers. This contact information may be used to inform users about ELTEL's services.
  • Statistical data is collected anonymously in order to better understand usage and continuously improve the service.
  • The recipient of this personal user data is solely ELTEL. This data will therefore not be subject to any transactions whatsoever with third parties.

The User has the right to access, rectify, erase, and restrict the processing of their data, as well as the right to data portability. The User may also issue instructions regarding the retention, deletion, or disclosure of their data after their death.
The User can contact NAICT and the competent authorities and exercise their rights by calling or writing (sms or whatsapp) to ELTEL SERVICES customer service at 242181425.
User data is processed in accordance with its Privacy Policy relating to the protection of personal data and privacy.

ARTICLE 7 – APPLICABLE LAW – GENERAL PROVISIONS

If one or more provisions of this contract are deemed invalid or are declared as such by law or regulation or as a result of a judicial decision made by a competent judicial authority, the other provisions shall remain in full force and effect.
Any provisions declared null and void will be replaced by provisions that most closely approximate the content of the originally agreed-upon provisions. ELTEL and the User will not be held liable or deemed to have breached these terms of use in the event of delay or non-performance if the cause of the delay or non-performance is due to force majeure as defined by Cameroonian case law.
Unless otherwise provided by applicable law, the terms of use between users and ELTEL are governed by Cameroonian law. Any dispute or claim arising from these terms of use between users and ELTEL, or any breach, termination or invalidity thereof, shall be submitted exclusively to the competent courts.

ARTICLE 8 – CONTACTS – COMPLAINTS

Any complaint or dispute concerning the website must be reported to ELTEL customer service by phone or in writing (SMS, WhatsApp, or email) at 242181425 and eltelservice@outlook.com, respectively. This does not preclude the User's right to bring their complaint against ELTEL before the competent authorities.
